Beach Vacation Fun, and its owner, eBrains, Inc. ("we" or "us") have provided this privacy policy because we value your right to privacy. This policy is effective as of November 21, 2008 and governs the collection of personal information through this website on or after this date.

This Privacy Policy describes principles and practices that apply to Personal Information collected from users ("you") of our web site, email communications, sweepstakes, contests, or other communications. Please read this policy carefully before providing us with any personal information.

Your California Privacy Rights

Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (1) a list of the categories of personal information, such as name, address, e-mail address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties' direct marketing purposes, and (2) the names and addresses of all such third parties. We will respond to such written requests within 30 days following receipt at the e-mail or mailing address stated above. If we receive your request at a different e-mail or mailing address, we will respond within a reasonable period of time, but not to exceed 150 days from the date received. Please note that we are only required to respond to each customer once per calendar year.

The remainder of this policy describes our Personal Information handling practices in detail.

Information we collect.

1. Unregistered users

We encourage you to register with us in order to take advantage of Beach Vacation Fun’s many free offers and information. However, you may choose not to register and take advantage of any feature of our site where registration is not required.

If you do not register, then the information we collect from you is limited. We log your IP address in order to help diagnose problems with our server, administer our Web site and track usage statistics. Your IP address may vary each time you visit, or it may be the same, depending on whether you access our site through an always-on type of Internet connection (e.g., cable modem or DSL), or through a dial-up connection (e.g., AOL or Earthlink). Either way, it would be extremely difficult for us to identify you through your IP address, and we make no attempt to do so. If you reached our site by clicking on a link or advertisement on another site, then we also log that information. This helps us to maximize our Internet exposure, and to understand the interests of our users. If you visit one of our partners’ web sites by "clicking-through" from our site to their site, and you have registered with us, then certain information about you that you have provided to us may be transmitted by us to them.

2. Registered users

If you choose to register with us, you'll be able to receive emails from us providing you access to free offers and information from us and our partners. The benefits of registering will increase over time as we get to know you better and introduce new features. We encourage you to register so that you can experience everything that Beach Vacation Fun has to offer!

If you register with us, we will collect personal information from you in addition to the non-personal information described above. That personal information may include your name, email address, mailing address, travel preferences, as well as contact information for other people that you provide to us. The information we collect may vary, but we only collect the information that you manually enter into our forms or otherwise authorize us to collect. We may store all or some of that information in a cookie file on your hard drive, so that our system may recognize you each time you visit our site. In that way, we can save your preferences from visit to visit and can have the ability to present you with a customized Web site, without requiring you to log into our site every time you visit. To improve services and enhance personalization, we may periodically obtain information about you from other independent third-party sources and add it to your registration information. Additionally, authorized Beach Vacation Fun personnel may update your registration information to accurately reflect any new information included in communications received from you.

If you visit our site by "clicking-through" from a site operated by one of our partners, and you have registered with that partner, then certain information about you that you have provided to that partner may be transmitted to us. By choosing an offer and clicking the Submit/Continue button, you authorize Beach Vacation Fun to pass your personal information on to the Advertiser(s) whose offer you selected to receive. Because Beach Vacation Fun does not have direct control over the content of the Advertisers' offer(s) or the quality of the goods or services offered via such offer(s), you acknowledge and agree that Beach Vacation Fun is not responsible for and in no way guarantees or endorses: (1) the availability of the offer(s) offered by the Advertiser(s); or (2) the goods or services offered via such offer(s) by the Advertiser(s). Accordingly, you acknowledge and agree that Beach Vacation Fun shall be responsible or liable to you in any manner, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with use of or reliance on the content of any offer(s), any of the Advertiser(s) website(s) and/or the quality of any goods or services offered by or through any Advertiser offer(s) or website(s). As further protection for you, upon submitting your opt-in selections, Beach Vacation Fun may send you an automated e-mail confirming each of your offer selections. If you decide not to receive information from that Advertiser, simply opt-out of the offer by using the directions included in the email message. If you opt-out of the offer by using the directions included in the email message, you will not be sent any further messages from Beach Vacation Fun in accordance with our then current policies and procedures and will not be sent to the applicable Advertiser(s). However, if your information has already been sent to the Advertiser(s), Beach Vacation Fun will send a notice of your opt-out to the applicable Advertiser(s). Since information about you will be provided to the Advertiser(s) of your selected offer(s) and Beach Vacation Fun has no control over the use or distribution of your personal information once it is passed to an Advertiser, we strongly encourage you to review the privacy policy of each Advertiser which provides offers to which you opt-in before making a selection.

Consent

BY SUBMITTING PERSONAL INFORMATION TO US, AND/OR BY USING OUR SITE, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW.

If you do not agree with these terms, do not provide any Personal Information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personal Information, we may not be able to provide you with Products or Services that can be offered on our Site only if we have access to certain Personal Information.

How we use the personal information we collect.

We use the personal information we collect to help both of us! As we mentioned above, registering with us allows us to send you emails providing you access to free offers and information from Beach Vacation Fun and our travel partners. In the future, it may also allow you to log into our site automatically each time you visit, rather than manually typing your user name and password every time. We may also use your personal information to periodically contact you with news or important information from Beach Vacation Fun, to provide you with other information or invitations related to your initial opt-in offers or the Beach Vacation Fun community, and to request your feedback on our site. In addition to these periodic updates, we may email you additional materials, but only if you specifically request them after receiving an invitation. These might include opt-in newsletters and other materials that you proactively request from Beach Vacation Fun.

You can cancel your registration with us by e-mailing us, and placing your email address in the subject of the e-mail. We will send you an e-mail to confirm your request. After we receive confirmation, we will remove your information from our active database, but some information may remain in our archives. We may not be able to remove your information from our partners' databases, if we have transmitted any information to them.

When you participate in contests, promotions, raffles, or sweepstakes

We may offer you the chance to win a variety of travel related prizes by sponsoring contests, promotions, raffles, or sweepstakes. If you choose to participate, we will collect Personal Information, such as your full name, e-mail address, or mailing address. If a third party administers the contest, your participation may be subject to that other party's terms and conditions, and privacy policy. Detailed information about these terms will be provided on the applicable form you will be asked to fill out.

What we do NOT do

We do not and will not, at any time, request your credit card information or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. Identity theft and the practice currently known as "phishing" are of great concern to us. Safeguarding information to help protect your from identity theft is our priority. Disclosure of your personal information.

Beach Vacation Fun does not sell or rent any personal information to any third party, other than our partners, as discussed in this policy. We may aggregate personal information from all of our users and provide that information in the aggregate to other parties, including advertisers, for marketing and promotional purposes. However, if we do so, that information will not be in a form that will allow any third party to identify you personally.

We may share some of your personally identifiable information with our parent company, our subsidiaries and sister companies around the world that are committed to providing you with a comprehensive array of travel packages and services to meet your travel needs. Sharing this information allows us to better understand the ways in which our various product and service offerings can assist travelers. It also enables us to provide you with information about travel opportunities in which you might be interested. We do not place restrictions on the use of personal information by our parent company, subsidiaries, or affiliates but they will treat it at least as protectively as they treat information they obtain from their other users. They also will comply with applicable laws governing the transmission of promotional communications, and give you an opportunity in any such email that they send to choose not to receive such promotional e-mail messages in the future.

We also may share your personal information with third-parties specifically engaged by Beach Vacation Fun to provide services to Beach Vacation Fun (such as market research firms, marketing services providers and advertising agencies), in which case we will require those parties to agree to use any such personally-identifiable data solely for the purpose of providing the specified services to Beach Vacation Fun. As you might expect, we must cooperate with legal authorities, and may in some circumstances be required to disclose personally identifiable information in response to requests from law enforcement authorities, or in response to a subpoena or other legal process. We don't expect this to happen, but if it does, we will provide only the information required. In other words, we will not simply turn over our database in response to a specific legal requirement. We can also turn over information about you if we believe we must in order to prevent a violation of the law, and by accepting this policy, you consent to our doing so, in our sole discretion. Steps we take to protect your personal information.

Beach Vacation Fun has implemented security procedures to help protect the personal information stored in our systems. For example, we limit access to personal information about you to employees who we believe reasonably need to come into contact with that information. But please know that there is no way for us to guarantee the security of your personal information.

Children's Privacy

This website is a general audience site, and we do not knowingly collect information about children. Should a child whom we know to be under 13 send personal information to us, we will use that information only to respond directly to that child to inform him or her that we must have parental consent before receiving his or her personal information.

Changes to this Privacy Policy.

We reserve the right to change this policy should we deem it advisable to do so. If we make material changes that will affect personal information we have already collected from you, we will make reasonable efforts to notify you of the changes and to give you the opportunity to amend or cancel your registration.
